BeyondPhysio Membership Agreement
1. General terms
These general terms for membership, (”the Membership terms”), are valid between you, (”the Member”, ”you”, ”your”) and BeyondPhysio AB, Corp. ID no. 559266-8007, (”BeyondPhysio”, ”we”, ”us”, and ”our”), when purchasing membership provided by us. These membership terms constitute the (”Membership Agreement”). The Membership Agreement is valid during the period you have a valid membership.
2. Purchasing terms
When you make a purchase from us, you consent to all the terms included in the Membership Agreement. If you make a purchase through our website, we will send you an order confirmation through e-mail, confirming your order.
3. Membership at BeyondPhysio

The membership is personal and can only be used by the individual member.

The membership cannot be transferred.

The classes/month included in your membership will not be transferred to the following month in case you don’t manage to attend all the classes. The number of classes will reset in the beginning of each payment period.

The Member can always upgrade his/her membership. Contact BeyondPhysio for instructions on how to proceed.

People over the age of 13 can apply for membership. If the member is not yet 18 years of age, the membership must be approved in writing by a legal guardian, trustee, or administrator.

BeyondPhysio reserves the right to deny membership for applicants who do not meet the membership requirements.
4. The member’s responsibilities

Members and other guests are responsible for their own state of health to the extent that they, without risk, can participate in the activities at BeyondPhysio.
5. Changes in opening hours

BeyondPhysio reserves the right to make minor changes regarding opening hours, equipment, the schedule for group training, as well as trainers as needed.

BeyondPhysio reserves the right to close off parts of the premises if necessary, e.g. for minor renovation, repairs, maintenance, and service work, as well as during in-house training.

BeyondPhysio reserves the right to close the premises for one month during the summer period. The exact period the studio will be closed will be informed with 60 days notice. During this period BeyondPhysio will offer the option for online training in case the Member wishes. Direct Payment will happen normally for that month that the studio will be closed and Membership will be extended for the amount of days the studio was closed during the summer period.
6. Period of validity, pause and cancellation of membership

The membership is valid up until 3 months, 6 months or 1 year from the purchase date, depending on which membership the Member chose to purchase and runs automatically until further notice until Member terminates the agreement. Termination of Membership shall take place no later than 14 days before the end of the membership. Such termination shall be made in writing via email to info@beyondphysio.se. If Membership is not terminated in writing via email, the membership is extended by a new membership period of one (1) year.

The Member has the right to freeze its membership for one month during the summer holidays. Direct Payment will happen normally for that month and Membership will be extended for the amount of days it was frozen during the summer period. Member should inform BeyondPhysio by email to info@beyondphysio about its desire of freezing the membership during summer and the period it will be frozen with 14 days notice from the date the Member will freeze the membership.

During a prolonged period of illness, (confirmed by a valid certificate), we will freeze the membership, entailing that it will be extended for the period when you cannot use your membership. In special circumstances, when an extension is impossible due to exceptional circumstances, a Member may ask for cancellation of the membership and a refund by email to info@beyondphysio.se.

BeyondPhysio has the right to cancel a membership immediately, permanent or temporary, if the Member violates the Membership Agreement in the manner stated below and not do perform a correction within 14 days after the request from BeyondPhysio.

The Member neglects the monthly fees, neglects to make a payment, in spite of reminder at the latest 30 days after the due date on the invoice.

7. Prices, price changes, and payment

You can find the current price list for membership and training products on our website, see https://www.beyondphysio.se/membership-plans. All indicated prices include VAT.

BeyondPhysio can change the price of membership. Though, price changes will not be backdated, entailing that you will pay the price in force when you made your purchase.

Purchases can be made with credit card and invoice.

In case of delayed payment, BeyondPhysio has the right to charge penal interest and administrative fees, as well as charges for collection of debts.

Paid membership monthly fees is non-refundable.
8. The right of withdrawal

When purchasing membership you have the right of withdrawal within 14 days without due cause. If you want to use your right of withdrawal, you have to notify us within 14 days from the day you received the order confirmation. If you have used the membership or the training product you purchased, we will make a deduction corresponding to the time you used from the membership/training product from the amount to be refunded.

If you want to use the right of withdrawal, send a clear notification to BeyondPhysio before the 14 days period ends. For prompt management, the notification should include [your name], [your address], [invoice number], [mobile], [e-mail address] and the membership concerned, if your order includes more than one. The notification can be sent through e-mail stated on our website. Otherwise, use the standard form for the right of withdrawal from the Swedish Consumer Agency, see here or contact us, we will send you a form.

If you regret your purchase, we will refund all payments we have received from you, (with a deduction of any use according to the above). The refund will be performed without undue delay, and in any case, at the latest 14 days from the day, we were notified of your decision to use your right of withdrawal. The refund will be carried out through the payment method you chose in your order if no other explicit agreement has been made. In any case, the refund will be free of charge.

10. Responsibilities
BeyondPhysio is not responsible for personal injuries or damages to property, caused by you or another Member when staying on BeyondPhysio's premises. Though, BeyondPhysio is responsible for damages to property caused by faulty or inferior training equipment if due to neglect or carelessness by the staff of BeyondPhysio.
11. Force Majeure

BeyondPhysio is not responsible for interruptions in training opportunities that are due circumstances beyond BeyondPhysio's control, such as water damage, fire damage, or other damage at the training facility, strike, lockout, natural disaster or government decision.
12. Complaints

BeyondPhysio always strives to make you, as a member, satisfied with your membership. If you want to make a complaint or a point of view, you are always welcome to contact us. You will find our contact information under item 9, (Notifications), above.
13. Changes of the Membership terms

BeyondPhysio reserves the right to change the Membership terms. When changing the Membership terms, the Member is notified according to item 9 above, before the change comes into force. If BeyondPhysio changes the Membership terms, the Member always has the right to cancel the Membership. If the Member cancels the Membership Agreement, it will expire the day before the change comes into force. In addition, the Member has the right to a refund of the membership, corresponding to the period left to use after the cancellation comes into force. Cancellation is to be performed within 14 days from the day you were informed about the changes.
14. Image and film management

In the training sessions or events BeyondPhysio might take photographs or make video recordings. Such photographs and videos may be used in social media and is reproduced on the website, news and information mailings and in other marketing. By participating in training and events, BeyondPhysio presupposes that the Member accepts BeyondPhysio to use photo and video material for the above purposes.
15. Processing personal data

Member's personal information is only handled by BeyondPhysio and by companies that are so-called personal data assistants in those cases that BeyondPhysio needs the help of these companies to be able to offer its services. A personal data assistant is a company that processes personal data for BeyondPhysio's account and according to BeyondPhysio's instructions. BeyondPhysio has written agreements with every personal data assistants through which they guarantee the security of the personal data processed and undertaken comply with BeyondPhysio’s safety requirements. In addition to the personal information the Member himself submits to Pilates Complete, Pilates Complete may also collect personal data from so-called Third Party. For example Pilates Complete may collect data from social media. Pilates Complete has personal data assistants who help with invoicing and payment solutions as well as booking systems.
